On October 9, 2018, the City Council of Garfield passed Ordinance 179 to establish regulations for the placement, construction, and maintenance of antenna arrays and communication towers. Authority for municipalities to regulate such structures is provided by the Federal Communications Act of 1996. Ordinance 179, for simplicity referred to here as, the Cell Tower Ordinance, includes the following: purposes for the regulations, definitions, general requirements, location and application, development standards, collocation, abandonment, environmental impact, review, and compliance with federal law.
Due to the urgent need for the City of Garfield to have a current ordinance to regulate the placement, construction, and maintenance of antenna arrays and communication towers, to serve the citizens of Garfield, Ordinance 179 became effective on the date of its passage.
